Seven Shots Fired at a Car Carrying a Five-Year-Old — ICE Operation Disputed in New York
A US immigration enforcement officer shot a 28-year-old man in the neck during an arrest operation in New York on Thursday. His five-year-old son was sitting in the back seat when shots were fired. Federal officials say the driver threatened officers with his vehicle, but New York's police commissioner has disputed their account. The incident has prompted protests, a federal investigation and a fierce debate over ICE tactics.

Seven Shots Fired
The incident occurred at around 4 p.m. on October 8 in the Marble Hill neighbourhood of New York. Marble Hill is administratively part of Manhattan but geographically connected to the Bronx. The man was identified as Oscar Belgal, a 28-year-old citizen of the Dominican Republic. New York Police Commissioner Jessica Tisch said at least seven shots were fired at Belgal’s vehicle; NYPD commanders said a single ICE agent fired them. Belgal was struck in the neck area and taken to hospital. His five-year-old son was in the back seat and was not physically injured. The NYPD said it was not involved in the shooting and was not at the scene when it happened.
Federal Officials Say the Vehicle Was Used as a Weapon
On Friday, October 9, the Department of Homeland Security presented its version of events. Marcos Charles, head of ICE Enforcement and Removal Operations, said Belgal refused to leave the vehicle when officers approached, then drove away, struck two ICE vehicles and headed toward officers. Federal authorities therefore contend that the car was used as a weapon and officers were in danger. Homeland Security Secretary Markwayne Mullin endorsed that account and defended the officers. This remains the federal government’s account: no final public investigative finding has established the precise sequence of events or whether the shooting was justified.
Did Officers Know a Child Was Inside?
One of the most serious questions concerns the five-year-old boy in the back seat. Mullin said on Friday that officers did not know the child was in the car when they fired. The statement raises questions about planning and what information officers had before attempting the arrest. It has not been independently established whether the child was visible to officers or when they first became aware of him. The boy escaped physical injury.

ICE’s Account Is Disputed
The federal claim that Belgal rammed ICE vehicles has been disputed — including by the city's own police commissioner. Jessica Tisch said Belgal was pulling into a parking space when the agents approached. Photographs and video show a damaged vehicle with holes in its windows and officers arresting the man. Such material can help verify parts of the incident but does not necessarily show everything that happened before the shots. It is important to distinguish verified facts from the competing accounts of federal and city officials while those accounts conflict.
Judge Temporarily Blocks Deportation
The case has also entered the courts. ABC News reported that a federal judge on Friday barred the government from deporting Belgal for the time being, granting a petition from immigration advocates. That ruling does not decide whether the arrest or shooting was lawful. It does mean the matter is before the judicial system while the incident itself is investigated.
What Is Known About the Man?
DHS describes Belgal as being unlawfully present in the United States and has referred to previous arrests, convictions and alleged gang connections. These claims must be attributed to the authorities making them. A person’s criminal history may be relevant when planning an arrest, but it does not by itself determine whether firing a weapon was necessary at the moment force was used. That assessment must rest on the circumstances of the shooting.
Mayor Calls for Changes
New York Mayor Zohran Mamdani condemned the incident and criticized ICE operations in the city. He said he spent two hours on the phone with President Donald Trump and Homeland Security Secretary Markwayne Mullin seeking Belgal’s release, without success, and called for ICE to leave the city. Governor Kathy Hochul urged a halt to ICE operations in New York and called for body-camera footage to be released, while Attorney General Letitia James called for a full and transparent investigation. Federal officials defended the operation and criticized city immigration policies. The dispute reflects broader tensions over US immigration enforcement and the balance of federal authority with state and municipal self-government.
FBI and HSI Investigate
The FBI and Homeland Security Investigations (HSI) are investigating the shooting. Questions remain about why seven shots were fired, whether alternatives were available and whether the use of a firearm complied with applicable rules. Investigators must also establish whether recordings, communications or other evidence corroborate the accounts given by federal and city authorities. Protesters gathered in New York demanding answers.
The Question Investigators Must Answer
The shooting has attracted attention far beyond the neighborhood where it happened. A five-year-old child was inside a vehicle when seven shots were fired; his father was wounded, and federal and city authorities describe the lead-up differently. The investigation must determine not only what happened, but whether the decision to shoot was necessary, justified and lawful. Until findings are available, the claims on all sides should be subject to the same evidentiary standards.
